Typical situations

Sound familiar?

Suspicion

“That product looks just like ours.”

A competitor launches a suspiciously similar product – we analyze it technically using claim charts against the actual product – as a basis for the law firms' legal assessment.

Imports

Cheap imports undercut your prices

Enforcement is particularly effective against imports from the Far East: injunctions, border seizures, damages.

Unused IP

Patents without a product

Portfolios from discontinued projects or legacy holdings can be licensed or sold – we find the partners.

Why fight back?

Enforcement is your strongest lever.

Injunction

An end to the infringement

German courts and the UPC regularly grant injunctions once infringement is established – the product disappears from the market, or the infringer takes a license.

Damages

Compensation for the past

Damages for past use – calculated as a reasonable royalty, the infringer's profits or lost profits.

Negotiating power

Proceedings open doors

Enforcement often ends in a license or a comprehensive settlement – on terms that would be out of reach without proceedings.

FAQ

Quick answers.

What does enforcement cost me?

As a rule, nothing out of your own pocket: litigation funding covers attorneys' fees, court fees and expert costs as well as the adverse-cost risk if the case is lost – in exchange for a share of the proceeds.

We are much smaller than the infringer. Does it make sense?

Yes. Funding levels the playing field, and the cost risk does not lie with you. Among other cases, we are currently supporting an individual inventor against a multinational software provider.

How long do patent infringement proceedings take?

In Germany, a first-instance judgment is possible in around 12 months – considerably faster than in the US. Many cases settle before then.

Do I have to manage the proceedings myself?

No. If you wish, TYR coordinates attorneys, experts and funders. You make the decisions; we take the workload off your shoulders.
